i think we didnt Watch the same match... a feet in the head is perhaps something normal in rugby... a non citation is something dangerous for rugby. if your son were in place of this poor Kearney i dont think you would say it s boring, very boring... but it s your point of view...

i didnt come across right in my other posts, nothing against mary hinge.
firstly i thought it was a red and a few games ban, yes god knows what damage it could be done. u cant go threw someone's head to get the ball.
as said by someone else, POC was never going to get banned with munster in the heineken cup semi final and lions tour coming up.
im surprised nigel owens didnt take action, although he is fairly, buddy buddy with munster, covers alot of there games. POC didnt stop bitching all threw the game, wasnt like him at all, if that was donkey cullen then it wouldnt be a surprise him bitching.
when i said it was boring, i ment it was done to dead, on other forum, papers, tv, facebook, newspapers etc.
bad choice, we cant change it, wasnt right.

Anyway, The system is flawed. There isnt a chance that he was going to Cite him with the season being the way it is with a semi coming up. If he cited him he would be stating that on the evidence available that he had a case to answer. It was better to not cite and nip it in the bud.
The citing officer should be as independent as the ref.
The problem is that he must use the laws of the game to interpret the actions, and under 10.4.c Kicking Paulie is guilty...
it's defined in black and white thus:
LAW 10 : FOUL PLAY
Foul play is anything a player does within the playing enclosure that is against the letter and spirit of the Laws of the Game. It includes obstruction, unfair play, repeated infringements, dangerous play and misconduct which is prejudicial to the Game.
(c) Kicking.
A player must not kick an opponent.
Sanction: Penalty kick
And while O'Connell's intention may have been to kick the ball, he kicked the man and hard. It was most definitely outside the spirit of the Laws of the Game and intent is actually irrelevant.
The precedent the lack of action taken creates could seriously come back to bite the IRFU/IRB in the ass at a later stage IMO...

The only relevance I suppose is the issues we ourselves have been on the receveing end of from incorrect or non-application of the disciplinary process over the years after the Inter-pro's.
Just another episode to add to a long list of questionable decisions. But a poor decision IMO not to call him in front of a panel at least (irrespective of censure) because you don't want to see that happening again to any player regardless of intent, and even worse to wait until two days after the citing deadline for the Pro12 to communicate anything out....

David Jordan , Tournament Director of the RaboDirect PRO12, today reiterated the disciplinary procedures in relation to the citing process in the RaboDirect PRO12 at present, following comments made by some quarters after the Munster v Leinster match last Saturday.
The Citing Commissioners in all domestic competitions are selected on their independence and experience and appointed by the respective Unions. In each of the RaboDirect PRO12 countries, independent Citing Commisssioners are appointed for matches, avoiding where possible the Citing Commissioner’s own club, province or region. This is similar to the French Top 14 and England’s Aviva Premiership
‘The independent Citing Commissioners in the RaboDirect PRO12 attend the matches and take note of any indicators of possible foul play. They can then seek further information from TV, medical, team officials and players immediately after each game. The independent Citing Commissioner has a maximum of 48 hours from the final whistle, to notify the Tournament Disciplinary Officer of a citing. The independent Citing Commissioner will have reviewed the match DVD, usually with extra TV angles, to confirm his decision.
‘ In the specific Munster vs Leinster game last Saturday, the independent Citing Commissioner from Connacht considered all incidents and decided that there were no citings forthcoming, i.e. no incidents that would have warranted a red card. Last Monday morning, the Disciplinary Officer, Tournament officials and team managers were notified of this decision and this was confirmed to the media upon enquiry.
‘Only if the independent Citing Commissioner decides to cite, does the Disciplinary Officer has the option to refer the citing to an independent “gatekeeper” for a second opinion. An independent Judicial Committee is appointed by the Chairman of the independent RaboDirect PRO12 Disciplinary Panel to formally consider the citing normally later that same week’.
